When the worker can think of himself or herself as being "terminated" as opposed to being abruptly "fired," the personnel negative feelings toward the employer do not linger and the productivity of their remaining coworkers does not suffer. Once one employee gets away with problem behavior, this gives other personnel ammunition for that same behavior. Other workforce may file suit against you for failure to act on the problems you're having with the worker. Occasionally though, the verbal warning is not enough. When separating for a company reason and competitive pressure, you should thoroughly document the economic trends and strategic changes which drive your layoff. These will come back to haunt the dismissed worker in her unlawful termination case. Typically the worker's legal adviser will ask for a positive cover story during settlement talks for a negotiated lay off (high-risk). Unless this person is prone to violence, theft or something wicked, you must provide a notice of recommendation.

The purpose of this article is not to pitch you on my lay off manual and proprietary procedures, but to give you some real help with dismissals whether you decide to get my manual or not. Next, I noted you didn't share some important information about one of our suppliers. They'll be angry with management. Start a formal evidence procedure and give consistent feedback to the employee. You should encourage the employee to seek their own legal counsel if they're unsure about the waiver. You should make sure a person does not have the right combination of qualifications for the job. Certainly if the jobholder gets a new full-time job, he's immediately ineligible. Often, they are personnel who are disobedient or who have a bad outlook, and they do major damage to your workplace environment and performance.
